Your Own Italian Adventure 2024 Official Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. MUST BE A CA RESIDENT.

1.) PRIZES:

a.) One Grand Prize Winner will receive the following Sweepstakes Prize Package: (the “Prize”), with a total estimated value of up to $4,900, which will include the following:

• Airfare: Two (2) round-trip economy airfare tickets for the Winner and one guest, not to exceed a total amount of $1,500.00 per ticket. Valid for one year after winning. Grand Prize Winner must provide the desired dates of traveling to Sponsors at least 2 months prior to expected travel date as to allow Sponsors enough time to plan the trip accordingly. Valid on flights from the winner’s nearest USA major commercial airport to their choice of city. The total estimated value of airfare: $3,000.00.

• Hotel Accommodations: Four (4) nights of hotel accommodations for two (2). One hotel room, double occupancy. This reservation has no monetary value and is not extendable or transferrable. The estimated value for hotel accommodations: $1,000.00.

• Ground Transportation: transportation to and from the airport to the hotel.

• Entertainment: Remaining balance of prize will be given to winner for activities in chosen city up to $900

• Approximate Retail Value of the Total Prize package is $4,900.

Meals and beverages, incidentals, gratuities, phone calls, luggage fees, travel insurance, travel taxes, and any other expenses not specifically mentioned herein are the sole responsibility of the Winner and the winner’s companion. Sponsors (Palm Bay International and Cavit Winery) reserve the right to substitute any portion of these prizes, including travel date and destination, for a prize of equal or greater value. Sponsors will determine all elements of the prize at their sole discretion. The prize may not be assigned, transferred, exchanged, or redeemed for cash. The prize is awarded “as is” with no warranty or guarantee express or implied. Sponsors disclaim all and any liability for the actual provision, quality or nature of any third-party product or service accepted by the winners. Entrants understand that Sponsors are not liable for injuries, losses, or damages of any kind arising from participation in this promotion and acceptance, possession, and use of the prize. The winner is responsible for all taxes and fees associated with the Prize receipt and/or use.

b.) Four Runner Up Winners will each receive one (1) outdoor pizza oven, valued at $370 each.

Entrants agree to be bound by the Official Rules and agree that if a winner fails to provide proof of identity, is found to have violated the Official Rules, or otherwise does not meet eligibility criteria, the Prize will be forfeited and awarded to an alternate winner. Decisions of Sponsors are final and binding in all respects.

2.) WINNER DETERMINATION: Potential Winner will be determined in a random drawing on or about July 15, 2024, by Sponsors, whose decisions will be final in all matters relating to this sweepstakes. The total number of eligible entries received will determine the odds of winning. Potential winners will be notified at the sole discretion of the Sweepstakes Sponsors either by email or text on or about July 15, 2024. To be elevated to a Winner the Potential Winner will be required to sign an affidavit of eligibility and liability/publicity release within seven (7) days of notification or the prize will be forfeited and may be awarded to another winner. If a potential winner cannot be located or does not respond within seven (7) days, the prize will automatically be forfeited, and an alternate winner selected. If a valid prize winner cannot be reasonably determined within 6 months from the ending date of the sweepstakes, at the sponsor’s sole discretion the prize may be altered or canceled. Except where prohibited, acceptance of the prize constitutes the winner’s consent to use of his/her name, likeness, and biographical data for advertising and promotional purposes without additional compensation. The prize is not redeemable for cash and is not transferable.

3.) TERMS & CONDITIONS: No purchase is necessary to enter or win. A purchase will not improve your chances of winning.

4.) ELIGIBILITY: Must be at least 21 years of age to enter. This sweepstakes is open to residents of California only, except for the following and their employees and their families: Palm Bay International Inc. and their respective affiliates, printers, advertising and promotion agencies, beer, liquor, and wine wholesalers and retailers and employees of any federal or state liquor authority. All federal, state and local laws apply. Void where prohibited. All federal, state and local taxes are the winner’s sole responsibility. By accepting the prize, the winner waives the right to assert as a cost of winning said prize, any and all costs to redeem the said prize, and any and all liability that might arise from redeeming or seeking said prize.

5.) HOW TO ENTER: The Choose Your Own Italian Adventure Sweepstakes (the “Sweepstakes”) is sponsored by Palm Bay International Inc. and Cavit, (“Sponsors”). Beginning 12:00:01AM (PST) on March 1, 2024, you may enter the Sweepstakes in one of two ways:

TEXT TO WIN ENTRY: You may enter via the text to win number 833-660-1619 and type in the word provided on the Sweepstakes point of sale (“Official Text Entry”). Message and data rates may apply. ALL TEXT ENTRIES MUST BE RECEIVED BY 11:59pm (PST) ON JUNE 30, 2024 (the “Expiration Date”). ONLY ONE (1) TEXT ENTRY PER PERSON, PER NUMBER WILL BE ACCEPTED.

Note: Text entry must be made by the entrant only via the provided number. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device to automate the entry process is prohibited.

ALTERNATIVE ENTRY: To enter via mail, you may send a self-addressed stamped envelope containing your name, address, e-mail address, and age (“Official Paper Entry Form”) to: Choose Your Own Italian Adventure Sweeps/Cavit Brand Manager – 48 HARBOR PARK DRIVE, PORT WASHINGTON, NY 11050. ALL PAPER ENTRIES MUST BE RECEIVED BY 11:59pm (PST) ON JUNE 30, 2043. ONLY ONE ENTRY PER HOUSEHOLD WILL BE ACCEPTED.

Limit one entry per person. Duplicate entries from the same phone number/person/household will be automatically eliminated without notice to the entrant. Sponsors reserve the right to disqualify all entries associated with the participant(s) involved. Odds of winning depend on the number of eligible entries received. No entries will be acknowledged or returned. The only entries that will be considered valid are those entered at the Official Text Entry or those received by Palm Bay International on the Official Paper Entry Form prior to the Expiration Date. No entry will be accepted or deemed valid if it is submitted through any other means. ONLY ONE (1) TEXT ENTRY or MAIL-IN ENTRY PER PERSON, HOUSEHOLD, AND/OR PER PHONE NUMBER WILL BE ACCEPTED.

The Sponsors prize suppliers and any and all phone server(s) and access provider(s) and prize providers (collectively, “Promotion Entities”), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releases”) are not responsible for: any incorrect or inaccurate entry information; human errors; lost, misdirected or destroyed mail entries; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site or any web pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof. Proof of entering information at the Entry Site is not considered proof of delivery or receipt. Illegible, incomplete, and duplicate entries will be disqualified. All entries become the property of the Sponsors and will not be acknowledged or returned. False, fraudulent, or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. The Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York. By entering the Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of the County of Nassau, State of New York, and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. Any entry information collected from Sweepstakes shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules.

6.) LIMITATIONS ON LIABILITY: The Sponsors shall not be liable to the winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsors’ sole control. Sponsors shall not be responsible for any cancellations, delays, diversions or substitutions, or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies, or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. The sponsors shall not be liable for any loss or damage to baggage.
